摘要(Abstract)：

爆破振动形成的爆破地震会对地面建筑产生影响,常因此发生侵权纠纷。以一具体案例提出金属矿采矿爆破振动对地面建筑影响的鉴定办法,对鉴定结论从行政法律关系和民事法律关系的不同角度进行了解读:两种不同法律关系既不包容也不替代——行政法律上的爆破许可并不意味着免除民事法律上的侵权责任。
The seismic blasting caused by blasting vibration would have an impact on the ground buildings,which often resulted in infringement disputes among residents in mine area.A specific case was chosen to put forward an approach to identify the impact on the ground buildings caused by blasting vibration.The identification of the conclusions will be interpreted in terms of administrative law relation and civil law relation: The two different law relations can neither be tolerated nor replaced with each other.Blasting permit in administrative law doesn't mean to let off infringement liability.
